A state panel wants to know if the DuPage County Election Commission’s housecleaning efforts violated Illinois law.
But the Illinois Local Records Commission stopped short of demanding an investigation when it notified authorities the election commission might have disposed of poll tapes and voter registration cards in violation of the Local Records Act.
“We have no enforcement authority,” said David Joens, director of the Illinois State Archives. “So all we are doing is sending on the allegations to the (DuPage County) state’s attorney and the (Illinois) attorney general’s office.”
On Thursday, officials from the state’s attorney’s office and attorney general’s office said they’re still undecided about how they’ll respond.
However, the nonprofit group that made the destroyed records claims against the DuPage Election Commission is demanding action.
“To instill confidence in our electoral process, we call for authorities to investigate the destruction of public records,” said Jean Kaczmarek, co-chairwoman of the Illinois Ballot Integrity Project.
According to the records act, local units of government can’t dispose of documents without getting written approval from the Cook County Local Records Commission or the downstate Local Records Commission.

I was under the impression that the Geneva Convention was a treaty that the US was a signatory of. As such, isn't it considered to be legal and binding on citizens of the US? And that the bill passed in the Senate essentially means that the US has withdrawn from the treaty?

Congressional Quarterly reports that Senate Majority Leader Bill Frist (R-TN) will not allow a key intelligence bill to be brough to the Senate floor and, according to senior leadership aides, "may shelve the measure entirely."
Writer Tim Starks at CQ describes the intelligence authorization bill as "a potential Pandora’s box for Republicans in the run-up to the November midterm elections," given the perception that Senate Democrats would use such a bill to hammer President Bush's Iraq war policies. "Frist does not want to give them the platform to do so," writes Starks, "because he considers a rehash of the war to be a waste of the Senate's time."
A second failed year for the bill would "neuter the Intelligence panels," the article states, meaning in essence that Congressional committees would be unable to provide strategic guidance to the US intelligence community.

What is going on in our Country? I cannot believe that I am now a citizen of a country that legally tortures people. I cannot believe that my president can now decide that any american citizen is a "enemy combatant" and can detain them without any proof and without any legal defense?? It is shocking, appalling and almost too surreal to believe. Where is the public outrage? Where is the public concern for human rights? What is going through the minds of those that support GW Bush and his terrorizing. I'm very afraid that our country is turning into a facist state... and no one cares!

Gas prices and the election:
Question? Whith unleaded gas prices in Ohio as low as $1.99, why is diesel still hovering around $3.00?
The high cost of diesel increases the price of all goods and services since they need to be delivered. Why did the price of unleaded drop by $1.00 in the past 2 months, but not diesel?

Ashcroft Is Denied Immunity in Case

A federal judge in Idaho has ruled that former attorney general John D. Ashcroft can be held personally responsible for the wrongful detention of a U.S. citizen arrested as a "material witness" in a terrorism case.
U.S. District Judge Edward J. Lodge, in a ruling issued late Wednesday, dismissed claims by the Justice Department that Ashcroft and other officials should be granted immunity from claims by a former star college football player arrested at Dulles International Airport in 2003.
Attorneys for the plaintiff in the civil suit, Abdullah al-Kidd, said the decision raises the possibility that Ashcroft could be forced to testify or turn over records about the government's use of the material witness law, a cornerstone of its controversial legal strategy after the Sept. 11, 2001, terrorist attacks.
Justice Department officials did not respond to telephone messages yesterday seeking comment. A spokeswoman for Ashcroft also did not respond to requests for comment.
Robin Goldfaden, one of Kidd's attorneys at the American Civil Liberties Union, said the case "could be the launching point for more fully documenting how the government is misusing the material witness statute."
The law was intended to give authorities the power to detain witnesses they feared might flee before testifying. But after the Sept. 11 attacks, the government used it to hold 70 men, nearly half of whom were never called to testify in court, according to a study by the ACLU and Human Rights Watch.

I have a couple of questions I wish I could ask George Macca Allen..
1. Are you typically in the habit of making up words during public speeches? That seems a habit fraught with hazards. People might actually try to look up the words you are making up. Not very smart for a public person to do that.
2. Can you give us a few other examples of when you made up words in public? If we are to believe you just made up this word, then it stands to reason that you have done this before. If not, it was not a great precedent to set for yourself.
and just a general question:
Since we are now one of the countries that permits torture, can we rendition criminals to, say Attica--or one of our other great penal institutions??

Brother-in-law of new Saddam judge slain 40 minutes ago
The brother-in-law of the new judge presiding over Saddam Hussein's genocide trial was killed and his nephew was wounded in a shooting Friday in Baghdad, the latest deadly violence linked to proceedings against the former Iraqi leader.
Kadhim Abdul-Hussein was fatally shot, and his son, Karrar, was wounded in the capital's western Ghazaliyah neighborhood by unidentified assailants, police 1st Lt. Thaer Mahmoud said.
It was not immediately clear whether they were targeted because they were related to Judge Mohammed Oreibi al-Khalifa, a Shiite Muslim who took over the Saddam trial last week, or if it was another of the sectarian attacks that have been plaguing Baghdad.
During Saddam's first trial, three defense lawyers were killed, and in July, Saddam and three other defendants refused food to protest lack of security for lawyers and conduct of the trial.
Friday's attack in the predominantly Sunni neighborhood of Ghazaliyah came a half-hour before the weekly ban on vehicular traffic in the capital that has been instituted to try to prevent suicide bombings on the Muslim holy day.
Al-Khalifa had been deputy to the original chief judge in the trial, Abdullah al-Amiri, who was removed on accusations he was too soft on Saddam. Among other things, al-Amiri had angered Kurdish politicians by declaring in court that Saddam was "not a dictator."
Saddam's nine lawyers walked out of the trial Monday to boycott the proceedings in protest of al-Amiri's removal.
Al-Khalifa later adjourned the trial until Oct. 9, saying he wanted to give the defendants time to persuade their original lawyers to end the boycott, or to confer with new attorneys.

I know this is from yesterday, but I podcast. I implore you to read all of this, and hopefully to paraphrase this on the air. The debate over your use of the N-word is extremely important, because it has the potential to distract from the real issue. George Allen?s racism, and by extension the Rapeublican party?s at best tacit embrace of racism, is a crucial message that must not be clouded by this.
To your callers, Jamillah and Evelyn, your point is wholly legitimate, and one that I shared over the past few days listening to the show. Sam, I think the piece of this that you might be missing is that the N word is not like other epithets. It was historically used in the way that a whip is used, not just to hurt, but to control and subjugate. It was a tool of conditioning used, not just on black folks, but on whites as well. The repeated use of the word was intended to condition white people to regard black people as less than human. In any case, the conditioning was so pervasive, so extensive, that the word itself has become like a whip.
The modern intent is less about conditioning and more about identifying. A white racist will often float a ?test balloon? to a new (white) acquaintance, to gauge that person?s level of racism. If all goes well, the newfound friends can end up having an N word hoedown.
The use of the word directly against blacks has declined significantly, a sure indicator of the cowardice of the racist mind. No longer in the majority, they now rely on ?secret handshake? words like ?Macaca?. This is the point that gets lost in your analysis of the Allen incident. There is no doubt he knew what the word meant. However, even those people who rightfully convict Allen for this do so under the assumption that the word ?slipped out?, revealing his true colors. It is my feeling that this was deliberate, a ?secret handshake? to his racist base, which he assumed that decent people would miss entirely.
The use of the word among black contemporaries is, I feel, also about identification, about bonding, while also a defiance against the word?s original intent. For folks like Evelyn, it still feels like a slap, it evokes that terrifyi

A federal judge ruled that “Halliburton employees working in Iraq and Kuwait are not entitled to overtime pay, even though a contract between the company and the U.S. Army called for it.” Between 20,000 and 40,000 overseas truck drivers, cooks, mechanics and others were promised the overtime pay. The ruling said “federal wage-and-hour laws don’t extend to work done outside the U.S.”

WASHINGTON (Reuters) - Disgraced lobbyist Jack Abramoff had hundreds more contacts with top White House officials than those Bush administration officials had previously acknowledged, according to a congressional report to be released on Friday.
The report by the House Government Reform Committee, a copy of which was obtained by Reuters, said the panel found about 485 contacts between Abramoff and his associations and the White House, including 10 with Karl Rove, who is President George W. Bush's top political adviser.
The committee based its findings on 14,000 pages of e-mails and billing records spanning three years ending in 2003, the committee report said.

According to the billing records and e-mails, Abramoff and his team had 485 lobbying contacts with White House officials between January 2001 and March 2004 -- 345 described as meetings or other in-person interactions, 71 described as phone conversations, and 69 e-mail exchanges.
The report found that more than half of the in-person contacts involved meals or drinks with White House officials.
One e-mail discusses how often Rove visited a downtown Washington restaurant then owned by Abramoff. "I am not kidding. Karl loves the restaurant (he's been there a lot) and we could do the back room," it said.
The report also quotes Abramoff about using Ralph Reed, former leader of the conservative Christian Coalition, to lobby Rove. Reed's recent bid to become lieutenant governor of Georgia failed, in part because of his Abramoff ties.
Abramoff and his team claimed to have lobbied the White House Office of Political Affairs in 17 instances, the report says.
In six of these instances, the documents describe a direct contact with Ken Mehlman, now chairman of the Republican Party. At the time of the contacts, he was director of the office.

Well Dubya was back in Ohio last night. That's right! Chief Chimpy was in the house. He was attending a fundraiser for Mike Dewine and Debra Price. Both are die-hard supporters of the Chimp in Chief. His host was billionaire, rabid Likud Party supporter, Les Wexner. It was held at Wexner's mansion in New Albany, Ohio.
A friend and I decided to go. We planned to join some fellow protesters. Now guess what? The entire town was blocked off. The closest we could get was to a library. It was located across from New Albany High School. Parents were there to pick up their children from practice. The police forbade them from crossing the street. Finally my friend and I gave up.
When we left, it was near dark. The parents were still waiting to receive clearance to pick up their children. It was said that Bush was 3 miles away from where we were located. What a coward?
We were told however, that some protesters were able to get through. My friend's son, an Iraqi Veteran, manage to give bush the finger.

Torture.
The hard fundamentalist Christian right is confused mostly because of their glorification of torture. Look at their icon of torture the naked brutally tortured body of Jesus Christ.
The torture of Christ is what led to their salvation and cleansing of sins. Without the torture which eventually resulted in the death of Christ their salvation would not have been possible.
As a result torture is good it is the only way to Salvation!

The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.
It expressly forbids suspension of the writ of habeas corpus except under very specific and highly limited circumstances – and as we are neither dealing with a case of rebellion or invasion at the time of this attempted enactment of this torture law in Congress, I am really wondering on what leg they propose to stand when arguing constitutionality at the first legal challenge to this law.
And if it is deemed unconstitutional, as it is likely to be, then all of this effort will have been for what? Congressional GOP and Bush Administration CYA? Correction Sam. The green party acknowledges Gore one. The Democratic party does not.
Don't blame Nader or us. Blame the democratic leadership of the senate that would not second the motion of the black caucus to look into the Florida vote. Instead they ratified the vote.
When I voted for Nader I was still a democrat. The day the new leadership councle rolled over and gave up the election I became a green.
To anyone doesn't like this, support IRV!

BTW, on the Olbermann piece on Jesus Camp last night, did anyone else notice the distinct absence of "campers" -- or anyone else, for that matter -- whom Sen. George Allen could refer to as "macaca?"
The only thing missing at that "camp" were the campers' brown shirt uniforms. That "camp" was all about indoctrination & brainwashing. The overseers didn't even bother to deny that. I wonder what those kids were getting in their kool-aid?
Did you catch the cardboard visage of Dim Son being prayed to? The camp's Drill Sgt.'s said prayed FOR, but we know better.

Americans voted for empire. Whether empire lite with the dems or empire thug with the bushbots, the choice was for empire. Only now it's becoming apparent empries and republics cannot coexist. Reumsfeld and Darth Cheney have always understood this fact of history and have moved with determination to destroy the republic while maintaining a facade of democracy. Hey, even Caligula had a Senate. We're living in momentous times - we are witness to the death of the american democratic experiment.

The war on Terror is a war on a concept. As such, its a war without end. So the republicans have given this so called president the power to do this indefinitely. Republicans should ask themselves "Do we want a democrat to have total power?" At least they should have exempted American citizens. This is truly a sad day.

As to Joe in Dallas - We are sorry to loose our local affiliate in Dallas and we are fighting hard to get a new station BUT we in Dallas have never depended on KXEB to be fans of AAR.
We at Dallas we have a fan group of over 500 people in 6 counties of North Texas and have had the group 2 1/2 years and before we had KXEB! We stream/podcast and have XM !!!

It will start slowly. People will begin to be removed from their homes, schools, places of work. Maybe your neighbor, maybe you. They will not start with high profile people, celebrities, media personalities, politicians etc.. It will be the "little folks" who are willing to speak truth to power yet lack a high profile status and therefore will not be noticed or missed. When some people begin to ask questions the nation will be told that measures are necessary to fight the war on terror and it is in the best interest of the country to insure the safety of the nation. As it happened in Germany, it will begin slowly, building momentum. Given the demonization by far right wing propagandists and politicians of progressives, liberals, Democrats, people of color, foreigners, and those with another religious persuasion, the ground work for more drastic measures to "protect" the nation have been put in place so that the people will be willing to accept whatever measures they are told are necessary. The authoritarian anti-democratic streak that lies just below the surface in the American psyche has been played to perfection by
those who detest democracy and justice. It's power solely for power's sake.
