It is curious to think how men have gambled, fought and slain one another over these unknown symbols, and it is interesting to wonder whether the most accomplished 'poker face' would fall a little on discovering that he was playing for lucre with emblems just as holy as the cross, the chalice and the crown of thorns. Probably not, for men have done things just as terrible in the name of symbols whose holiness they recognized. However, it is no less strange that the puritanic mind should see in diamonds, spades, hearts and clubs the signs of vice, to be avoided at all times and more especially on Sundays.
Today the forms of playing-cards are very different from the original Tarot, but an ordinary modern pack is not without significance, even though it may not be quite the same significance that was originally intended. What that was I do not know, but the living meaning of a symbol is what it means for each man personally. Therefore my interpretation of this particular symbol is not the result of research but my own intuition and has no claim to be \the\ interpretation. Like the often-quoted Topsy, the idea 'just growed' when I laid out the four suits of the pack and began to wonder what it was all about. It is said that 'the ways of the One are as many as the lives of men,' and as I worked at the symbol itself but also from the many possible interpretations that might be given it. However, we begin by laying out the cards in the form of a cross, thus:

So in the same way Einstein's relativity theories--the curvature of the propogation of light, the idea that time gets older as light moves away from a source, in other words, people looking at the world now on Mars, they would be seeing the state of the world a little earlier than we are now experiencing it. That began to bother people when Einstein started talking about that. But now we're all used to it, and relativity and things like that are a matter of common sense today. Well, in a few years, it will be a matter of commons sense to many people that they're one with the universe. It'll be so simple. And then maybe if that happens, we shall be in a position to handle our technology with more sense. With love instead of with hate for our environment.

Absent a widened attack, the Bushies' instinct is that this can be reduced to another tempest in a teapot. And if there is anything the Republicans possess in abundance over the Democrats, it is excellent political instincts.
Democratics have settled on the "falsified intelligence" angle as the way to attack the administration's misconduct in the Plame Affair. Sen. Reid said:
"The Libby indictment provides a window into what this is really all about, how this administration manufactured and manipulated intelligence in order to sell the war in Iraq and attempted to destroy those who dared to challenge its actions..."
With this strategy, it is not so much Valerie Plame's blown cover that matters as much as the light it sheds on the run-up to the Iraq war. The Bushies are confiden

A catharsis for those who were grieving for loved ones, spiritualism also embraced the theory of free love, a parallel movement that, according to author Barbara Goldsmith, "represented the ultimate expression of female liberation."
In "Other Powers: The Age of Suffrage, Spiritualism, and the Scandalous Victoria Woodhull," Goldsmith argues that a key to understanding the age of suffrage is understanding the influence of spiritualism, which empowered women whose channeled "spirit" voices had authority when their own social positions did not. It was just a short leap from leading seances in the homes of benefactors to demonstrating clairvoyant abilities in public halls, thereby enlarging the entrenched idea of home as "women's sphere." Acting on the strength of their spiritualist beliefs, suffragists turned their attention to the hypocritical legal standards that prevented them from being full participants in U.S. society. They demanded the vote.
Victoria Woodhull promoted views on women's rights that were at least a century ahead of her time. Married and divorced several times, Goldsmith's complex heroine was also a former prostitute and an advocate for prostitute's rights and had traveled the country as a channel f

Goldsmith's illumination of the convenient spiritualist leanings of robber baron Cornelius Vanderbilt, who was having an affair with Woodhull's sister, Tennessee Claflin, is one surprising tidbit. In her guise as a medium, Woodhull offered Vanderbilt financial advice through her trances, resulting in his investment in the Central Railroad. "It was rumored," writes Goldsmith, "that the commodore had allocated profits on 3,000 shares, or $93,000, to Victoria and Tennessee. When the commodore was asked how he had made such astute financial decisions, he laughed and replied, 'Do as I do. Consult the spirits.'"
Salon caught up with Goldsmith just before her national book tour to discuss how death and sex were common concerns among Victorian activists.

I mostly agree.
I have no idea about the masculinity bit, I'm not sure that comment makes much sense.
...but the "wanting a woman who wants nothing to do with you" part. That makes no good sense, IMHO, whether she's gay or not.
However, I often find the women I know who are lesbians to be very attractive. I like smart women. I like women who are whole people. Secure with themselves, friendly, open, well informed, etc.
A lot of times, it seems to me, that the best women I know are lesbians. Plenty are hetero and fabulous.
That a woman is gay doesn't stop me from loving the very lovable qualities of her.
Don't get lost in that love, though, if she can't give it back like you want to share it.
Best to just love her, let her go and move on to a woman who DOES have the capacity to return your love.

What is a common thread in nealy all mainstream progrming now? Division.
Nearly every sitcom follows this formula:
Male/husband is stupid and ineffectual.
Female/wife is cold and selfish.
Kids are preconsious bastards who merely allow their idiot parents charge of the house.
This theme is repeated over and over in commercials etc..
What have been the societal effects of this and who has bennifited?
6 corps now are responsibel for all that we see read and hear. Twenty years ago it was more like fifty, and even that was thought scandulous by communications researches.
For America to become as dumbed-down as it has, this and the destruction of the nuclear family and true alliances had to be destroyed...replaced with ultra-violence and backstabbing.
Keep them ignorant. Just like the slave masters did.

Don't be nervous Shell. They will love you. The Seniors that have no experience or little experience with computers are like littl kids. Just being able to get the info they want will have them hanging on your every word.

I was sad when Miles Davis died.
He was a great musician.
I saw Miles Davis at the (Fillmore/Village East).
I saw Dizzy Gillespie at The Blue Note, Sun Ra at The Joe Papp Theater, The Art Ensamble of Chicago also at The Papp Theater, Cecil Taylor at Lincoln Center, Sarah Vaughn at Baruch College Theater, Max Roach at 7 on Seventh, Pharoah Sanders at the Village Vanguard, Sam Rivers and Marion Brown at Studio Rivbea and Tito Puente at The Village Gate.
There were all these music lofts in Soho. A friend of mine was dating Ntozake Shange. There was a time when we would go to these lofts to listen to music and the entire cast of "For Colord Girls" would show up. They would come in and sit on the carpet, throw pillows, area rugs, etc. On one occasion Gil Evans walked in and sat down at the piano in the middle of a set and started playing. :)
It was like, Do you know who that is!!! :p

I think you misunderstood what we talked about on the phone. You seemed to think I said that Democrats were not in favor of business. I tried to point out that the Republicrooks were in bed with big business like Halliburton, Oil Companies, Pharmaceutical Companies, etc. Not small businesses of say fifty to a hundred employees. The big payoffs and the cronyism comes from the big boys. Ie: Halliburton and Chaney!
I am 61 and have always known that the Republicans are for the rich and the Democrats are for the poor and working folks.

My problem with Panthieism is really the inherent contradictory idea of multiple infinite beings.
The logical problems are rife, IMHO.

Yea, now it's coming back to me...
I did not really care for that album.
As I recall Miles Davis had a problem playing in the upper registers. Instead he adopted a very controlled, minimalist style of playing and preferred ballads.
I prefer his earlier work although his last album was pretty. It was interesting to see what he did with Cyndi Lauper's (pop) songs. I think the last album was titled Human Nature, and included True Colors and Time After Time. As I recall there was a period before that album where he was sick and had not recorded. I was sad when he died.

Been thinking about Bob Woodward a bit of late.
Trying to put my finger on how Woodward could a been this "crusading" young Turk back in the day and now he ain't naught but a palace courtier for a president, George W. Bush, who is infinitely worse than the man Woodward and Bernstein helped bring down -- Nixon.
Adding to the confusion is my long-held impression of Woodward from televised interviews and/or appearances as a rather strikingly thick-headed thin-skinned dullard. I allus watched Woodward and thought, "This plodding clod brought down Nixon?"
Never made no sense.
Then it struck me.
Watergate was an accident of history, at least for Woodward.
Woodward evidently didn't care fuck-all about exposing infamies in government (as his tenure w/Bush so ably demonstrates). No, what Woodward wanted was to be the guy w/access onna hot story.
B/c in the end, it's really all about Bob Woodward.
During Watergate, Woodward's access consisted, primarily, of the source "Deep Throat", who turned out to be No. 2 CIA director Mark Felt. Nother words, Bob worked w/what he had. His access consisted of a source criticizing the government, so he ran w/the guy that gave him the story.
The Bush Administration obviously learned a valuable lesson about Bob Woodward.
Cause what people learned over time is that Bob Woodward could be trusted to keep secrets, so the Bush administration especially must a figured, "Hell, better to have dumbass Bob on board singing our hosannas than looking over our shoulders for disgruntled cast-offs grousing out in the briar patches."
So the Bushies coopted Woodward. Brought him into the inner circle and let him "report" w/the deepest access possible for a journalist.
With alla the shit that happened right under "reporter" Bob Woodward's nose in the Bush White House, you just gotta know that Woodward has to be one of the most dim-witted, vainest, sanctimonious, selfish, egocentric beast-of-burden plow-horses in all of the elite media.

best long term fix is to buy a new bigger hard drive.
speed is a combo of several things.
an uncluttered OS, fast hard drives, and processor/memory speeds.
a trick is to be able to switch installs.
i have a cherry install with only the proggies
i need for a lil more speed. get a sata drive MB
and put in 10000 rpm sata drives. nice and fast!
dual core 64 bit processors fairly
nice as well. so basically
speed gains are always
hardware dependant.

I just got the same question when I did an interview with The Economist. I will tell you what I told them. What I pay for a sandwich is none of your business. It is a very private issue to me. I will talk about anything but sandwiches. My great aunt died in "The Great Mortadella Sandwich Incident" in the 1930s, and it is still very difficult for me to discuss sandwiches — any sandwich, and especially what I will pay for one.

Actually, it became my birthday about two hours ago central. We are going to the Rolling Stones concert tommarrow night. Meryl Haggart is opening up. We just got back from NO. City is coming back to life. It does not have that rotting garbage/death smell that it had in Oct. The zoo reopened and Kermit Ruffin held a thanksgiving concert down by the river. There seems to be a concentrated attempt to show New Orleans in the worse possibaly light. Things are not as bad as shown and we will be able to rebuild if we get the backing that was promised.

Facts I saw as relevant, with regards to the difference between charitable giving and campaign donations:
The National Christian Foundation (NCF) has $450 million in assets.
They are a leading financial delivery system. They brought nearly $1 billion to ministries, schools, conservative think tanks, and political activists around the country.
Donor-advised charitable funds are coming under increased scrutiny by the IRS.
Philanthropy watchdogs have raised questions about foundations that give lucrative business to individuals who serve on their boards.
In 1982, Terry Parker created the National Christian Charitable Foundation. His new methods needed a ruling from the Internal Revenue Service to ensure it was legal.

I heard that there were 200,000 homes lost and around 1,300 dead with more bodies coming in every day. There is going to be one hell of a legal battle over property issues. The city is a boom town for people looking for jobs which has caused a housing shortages. The moral of the people is great. The zoo reopening had all these kids laughing and enjoying themselves. The people who stay know what they are facing and only ask that it does not happen again.

I also visited Democrats.org to see the show's 'Fighting Dems' segment, clearly outlined by The Boston Globe story, linked at the top.
Hardly a reason to not find this show, qualified a major player in the political arena, wouldn't you say?
Demcrats.org would seem to be listening.

We are still not using our place so we staid in a hotel near St Louis Cathedral in the French Quarter. Funny to be tourist in my own city, but we had a great time. Saw Pappa Grows Funk at the Maple Leaf and then the Concert by the river the next day. The last day we went by our place and did some clean up as we lost most of our patio garden. We have this one bush who refuses to die and a banana tree that may make it, but all the rest was lost.

There was a 2 month grace period that ended weeks ago. Mortgages forclosed, evictions handed out in the 10's of thousands. People were not even around to be notified so if they weren't legally notified who's to know...
My guess is that evictions were rubber stamped and executed with the hopes that no one would file for a stay of execution.
If no one showed up the eviction was carried out legally.
Case closed.

A Vatican document which restricts homosexuals from entering the Catholic priesthood is expected or probably has been, released officially.
The short document takes a strict line on the clergy.
It says homosexuals should be barred from entering the priesthood.
Men with "deep-seated" homosexual tendencies and those who support gay culture should also be barred, according to the paper.
Those who have clearly overcame homosexual tendencies not lasting more than three years, may be admitted to the priesthood.
I do not concur, because it's my belief no three year waiver should be granted vis a vis the communion sacrament, as outlined by Pope John Paul II.

Yeah, people can be funny about CDs sometimes.
I remember plenty of emotional attachments to vinyl; each record could technically sound different.
Compact Discs don't really wear out, (they are still a recording mind you, 20+ years is pushing it) and usually fail due to misuse rather than age.
But there is that first time you get to hear an album...
Nothin' can take those memories away.

The HD Era
High definition is upon us, and Xbox 360 is ready. Games are required to be authored for 720p and 1080i, and all games are optimized for the 16:9 widescreen viewing ratio. That doesn't mean you have to have an HDTV to play Xbox 360 games. Xbox 360 games always look good, but they look spectacular on your high-definition display.

We can't forget that Bill Gates's new system can also reach across the network to access media from local, Windows-based PCs."
Then there's Major Nelson, who did a nifty comparison (with charts and everything) where he concludes, "When you break down the numbers, Xbox 360 has provably more performance than PS3."

Well, let's see here...I know those guys in spirit, right.
So that's a toughie.
I'd say, my favorite songs right now...is the Harmonizer work in the mid 70's to early '80s.
Things like reverse reverb effects, pitch shifting that came later, I think, plus the way John Bonham grew as a drummer with different voicings, in particular In Thru The Out Door.
A lot of that stuff is still pretty cutting edge, simply becuase it was an orchestrated and concerted effort from beginning to end, unlike the drop/cut/copy/paste stuff in the digital age today.
These algorithms were very much a product of those guy's intituition at the time, moreso than simnply what came from the factory as a pre-set.
So I would say, maybe I'm Gonna Crawl, or maybe The Rover. Something like that. Just wide expansive "Those Shoes" by The Eagles type songs, which really haven't lost their panache.
Just listen to the solo break by Joe Walsh in "Life In The Fast Lane", then pick up his solo work like The Confessor.
Progressive today, has too much Phish World Beat influence to me, or maybe too much southern Dave Matthews charm.
I like loud Yes or Rush classics, and that Mini-Moog/Hammond sound went the way of the Dodo bird around the time Yamaha dredged up off the fly samples for the R&B/Rap markets in the early 80's. It gets some revival from bands like Beck and Nine Inch Nails up to a degree, but mostly the loud wall of sound heavy metal guitar, chosses to simply accent their music with syth today, instead of complementing it as a separate voice in the arrangement.
I miss that.
It was a really cool thing back in the Pink Floyd days, or when lasers were big at the arena shows.
But to answer your question...I'd say Dazed and Confused. Because I can play it, yea. I have everything except the Markley talk box, the violin bow, the Les Paul Custom...and that analog effect...what's it called?
Er um...Treble Boost? Or was it germanium Fuzz?! I forget. Here's to rippin' off classic riffs at CBGB's.

The craftmanship of making a great album doesn't really happen nowadays.
Dark Side of the Moon has a consistent tone throughout it, and the songs are sequenced brilliantly. How the songs are strung together is extremely important. It's the same with a film and how it's edited. Many films seemed to be cut and pasted together. They don't have a cohesive flow like some of the classics.
Led Zeppelin never made a bad album. My personal fave is Physical Graffitti.
Presence is very underrated. Tea for One is a great blues number....

I think that the album came into itself with the Beach Boys Pet Sounds and the Beatles Sgt. Peppers. There had been albums before like Elvis Presley, the Bob Dylan stuff, and Meet the Beatles, but those two kind of showed what music could be.

Indeed! Often, I hear people complain about CDs only having 'one or two good songs'. Hence the popularity of compilations and singles collections. (NOW # whatever)
What's scary now, in this A.D.D. world, is when I ask people if a particular film is good or not, they answer with 'it's got a few good scenes'...
And just what I predicted would happen, has come true; a few months back I saw a TV special featuring the 100 greatest action scenes ever! (a video collection for the short attention-span types)

Concept albums were called pretentious by illiterate critics. Screw them. The fact that musicians were attempting to advance rock and roll artistically was wonderful. Bands like Yes, Emerson, Lake, and Palmer, Pink Floyd, etc., etc. were constantly "pushing the envelope". Zappa as well. Zappa's albums are brilliantly put together. Beautiful flow.
I don't think it's necessarily ADD (about people saying films have a few good scenes). I think it's true that films nowadays just have one or two rousing scenes, and the rest is filler, like an album with one or two great songs, and the rest is just there to fill out the CD.
I saw 2001 a few years back in a 70mm print. The audience didn't say a word. They were mesmerized. Even the teenagers in the audience kept quiet. Because it's a brilliantly made film. Something that goes beyond the usual. I think it's just because artists nowadays aren't really interested in the product. They seem to be more interested in fame instead of art.

Where's the next Pet Sounds? Blonde on Blonde? Joe's Garage? The Wall? Brain Salad Surgery? Close to the Edge?
Or the next Lawrence of Arabia? Current filmmakers can take a lesson from Mr. David Lean. He said that if you have a scene you adore, but it doesn't work in the final film, cut it. It will ruin the rhythm of your film. Too often directors have many scenes that just seem like a white sploch on a blackboard. While they may seem interesting at the time, they don't fit, and should be shown as a deleted scene.
I really don't watch deleted scenes very often. Or listen to some CD complilations where they have alternate takes. There's usually a reason why the artist didn't want it on the final album or in the film.
Dylan is the only one I know who's outtakes are just as good as the ones he left on the album. A recent Yes reissue of Tales from Topographic Oceans (one of my favorite albums) had a bonus track of a rehearsal of The Revealing Science of God, the first track on the album. Is that really necessary?

Kilroy Was Here was not one of Styx's better albums. It was the last one by the "classic" lineup, if I remember correctly.
They did a tour with that album with them playing roles on stage (with dialogue and everything). The fans were pissed. Remember seeing it on Behind the Music on VH1.

You go back farther and farther, the music becomes more and more complex and lengthy. Rich and well-to-do folk would sometimes travel for days to see classical performances or operas. They would last for many hours, of course all live as there was no way to record anything.
Then a gifted few in the audience would rush home and attempt to transcribe everything they had just heard, from memory!
I guess mp3 recorders are convenient after all...

That Sokurov quote reminds me of why I hate watching crappy movies. I recently watched The Swarm from 1978 (Hollywood is probably contemplating a remake of this, which actually may not be so bad, as the original is shit). I knew it was going to be bad, and it was unintentionally funny in many spots, but it was such a waste of time. I was angry when it was finally finished because I had wasted 156 minutes of my life. I could have watched Stalker, an Andrei Tarkovsky film I love (which roughly has the same running time).
Tarkovsky's film Stalker has nothing to do with the current definition of stalking.

I have yet to watch Parsifal, a film based on a Wagner opera. It's only 4 1/4 hours, which is rather short for Mr. Wagner.

I'm like Alvy Singer. I have to watch a film from beginning to end, even if the credits are in Swedish (or Russian).
The only Adam Sandler movie I saw all the way through was Punch Drunk Love. It was OK. I always felt Sandler had a creepy, vicious side to him, and it came out in that film.
It was NOT a masterpiece, like some people said.

I laughed at the end of Magnolia (with the frogs). I know he was trying for something big, but it was unintentionally funny.
There are some great moments in that film. A little too long. I like long films anyway, but it could have used a little editing.

Sandler's films are quite awful (at least the scenes I saw).
His comedy was typical for the 1990's. Childish, sadistic, rude, obnoxious, incredibly immature.

I had to watch Manhattan and compose a solid paper of this film in 48 hours. I watched the flick soooooooooooo many times--I was riffing on the split screen between Hemmingway and Allen as Motiff (wich it was!)...It was just a horrible experience for me.

It was shot on HD video, not film. Film cameras can't hold more than 10 minutes of film at a time.

N.C. judge declines protection for Diebold

RALEIGH, N.C. -- One of the nation's leading suppliers of electronic voting machines may decide against selling new equipment in North Carolina after a judge declined Monday to protect it from criminal prosecution should it fail to disclose software code as required by state law.
Diebold Inc., which makes automated teller machines and security and voting equipment, is worried it could be charged with a felony if officials determine the company failed to make all of its code - some of which is owned by third-party software firms, including Microsoft Corp. - available for examination by election officials in case of a voting mishap.
The requirement is part of the minimum voting equipment standards approved by state lawmakers earlier this year following the loss of more than 4,400 electronic ballots in Carteret County during the November 2004 election. The lost votes threw at least one close statewide race into uncertainty for more than two months.

I tried to 13B, But I ended up crying and gripping the stearing wheel till I was blinded by fear.
I had heard so much about Black ice, and Listened to others about how much they hated snow that fear took
over and I just gritted my teeth and Said today might be the day I die. I stopped at a resteraunt and asked the peeps if I was suppose to drive in it. and they were very kind and helpful, so I was able to calm down and enjoy it for a momment.

Basketball-sized piece of marble moulding fell from the facade over the entrance to the Supreme Court, landing on the steps near visitors waiting to enter the building.
No one was injured when the stone fell. The marble was part of the dentil moulding that serves as a frame for the frieze of statues atop the court's main entrance.
A group of visitors had just entered the building and had passed under the frieze when the stone fell at 9:30 a.m. EST.
Jonathan Fink, a government attorney waiting in line to attend arguments, said, "All of a sudden, these blocks started falling. It was like a thud, thud."
Ed Fisher, a government worker, said some of the marble pieces shattered, spraying the area with smaller chunks of stone. A group of students from Columbus, Ohio, pocketed some of the fragments as souvenirs, Fisher said.
Mark Goodman, a Washington resident, said some of the people who picked up larger pieces of stones took them back. "We'll have to look on eBay tomorrow," Goodman said.

The snowstorm that brought blizzard-like conditions and knocked out power to thousands across the Plains is heading toward the Great Lakes region. The storm dumped snow from North Dakota to the Texas Panhandle, closing hundreds of miles of highways and piling up drifts 6 feet high.
Five deaths were blamed on slippery roads in Minnesota, South Dakota, Nebraska and Kansas. A sixth person was killed when a tornado hurled a car in Arkansas.
I suppose you should know for the Ohio area, the concern right now is in Minnesota.
No watches have been issued by the Federal government. We have mist and fog at Akron-Canton airport, with expected showers in the late afternoon.
Temperatures will remain above freezing for the rest of the week...with some accumulations possible during the weekend. Highs should be in the upper 20's for Saturday.

A new report says Wal-Mart uses legal and illegal tactics to prevent its 1.3 million U.S. employees from forming unions. Released by American Rights at Work, Wal-Mart: Rolling Back Workers’ Wages, Rights, and the American Dream says the company has amassed a poor record on treatment of workers, including low pay, difficult working conditions and the company’s effective strategy for remaining union-free.
The report lays out evidence of Wal-Mart’s wide-ranging union-avoidance tactics, including profiling individual employees at stores that are likely to support unions and using an anti-union hot line for managers to call at the first sign of employee discontent and talk of organizing. Nearly 100 federal unfair labor practice complaints were lodged against the company in 1998–2003, according to the report.
The report follows other recent revelations about how the world’s largest retailer depresses local wages when it moves into a community, its settlement of a federal child labor case and an embarrassing internal memo about a proposed scheme to slash its health care costs by requiring “all jobs to include some physical activity” to screen out less hardy or healthy applicants. Even without the screening measure, fewer than half of Wal-Mart workers have health coverage on the job, according to an AFL-CIO report, largely because of high costs and limited eligibility. As a result, many Wal-Mart workers and their families must turn to emergency rooms and other public health services as their only health care option.

American Rights at Work Chair David Bonior says while most Americans are aware that Wal-Mart mistreats workers, “including accusations of gender discrimination, substandard health benefits and the denial of lunch breaks, most Americans don’t know about how Wal-Mart’s union-busting activity prevents workers from forming unions to address this mistreatment.”
Another report by the Wal-Mart Alliance for Reform Now (WARN), the community alliance providing a voice for citizens trying to get Wal-Mart to be a better corporate neighbor, and the Wal-Mart Workers Association released Nov. 18 shows Wal-Mart’s average wage is actually somewhere between $6.35 an hour and $7.69 an hour, much less than the $9.63 that Wal-Mart claims. The report, Wal-Mart Real Wage and Turnover Study, shows Wal-Mart’s annualized turnover rate is about 75 percent and that 975,000 workers enter and leave Wal-Mart jobs each year in the United States. As a result of such huge turnover, at any given time, the majority of employees are unlikely to be eligible for most benefits, the report says.
In a related development, corporate officials at Wal-Mart knew contractors the giant retailer hired to clean its stores were employing undocumented workers, according to an affidavit by a federal investigator and news reports. The October 2003 affidavit, which was unsealed by a federal judge Nov. 2, reportedly said a top Wal-Mart official encouraged a contractor to set up several “shell” companies to employ undocumented workers. The affidavit was unsealed at the request of undocumented workers who are suing Wal-Mart over alleged labor law violations.
Meanwhile, this week a new documentary, Wal-Mart: The High Cost of Low Price, is being screened in some 7,000 congregations, union halls, community centers and other sites as part of a nationwide effort by unions and their community allies to show the real Wal-Mart: a corporation that made $10 billion in 2004 while paying workers wages below the poverty level. Produced by Robert Greenwald, the documentary shows the effects of Wal-Mart’s greed through the personal stories of everyday workers and their families.

NO HOLIDAY FROM SHAME—Don’t let members of Congress forget how wrong their priorities are. On Nov. 18 they gave themselves their eighth pay raise since the last time the minimum wage was raised in 1997, when the House and Senate approved the Transportation/Treasury appropriations bill. Canadian Government Falls; Politicians Set to Campaign

TORONTO — Canadian politicians will hit the campaign trail this holiday season after opposition parties seized upon a corruption scandal to bring down the minority government of Prime Minister Paul Martin in a vote of no confidence.
Monday's loss means an election for all 308 seats in the lower House of Commons, likely on Jan. 23. Martin and his Cabinet will continue to govern until then.
The Conservative Party teamed up with the New Democratic Party and Bloc Quebecois to bring down the government, claiming the ruling Liberal Party had lost its moral authority. Recent polls have given the Liberals a slight lead over the Conservatives, with the New Democrats in third place.
The same surveys suggest the Bloc Quebecois would sweep the French-speaking province of Quebec, making a majority government unlikely no matter which party wins the most seats.

FAMILY LEAVE THREATENED—The Department of Labor is widely expected to cut back protections of the Family and Medical Leave Act (FMLA) that has helped tens of millions of workers since it was signed into law by President Bill Clinton in 1993. Big Business groups—including the U.S. Chamber of Commerce and the National Association of Manufacturers—are pressing to limit workers’ ability to take time off without pay for the birth or adoption of a child and to care for a sick loved one or for their own illness. Poisonings From a Popular Pain Reliever Are on the Rise
Despite more than a decade's worth of research showing that taking too much of a popular pain reliever can ruin the liver, the number of severe, unintentional poisonings from the drug is on the rise, a new study reports. The drug, acetaminophen, is best known under the brand name Tylenol. But many consumers don't realize that it is also found in widely varying doses in several hundred common cold remedies and combination pain relievers.
These compounds include Excedrin, Midol Teen Formula, Theraflu, Alka-Seltzer Plus Cold Medicine, and NyQuil Cold and Flu, as well as other over-the-counter drugs and many prescription narcotics, like Vicodin and Percocet.
The authors of the study, which is appearing in the December issue of Hepatology, say the combination of acetaminophen's quiet ubiquity in over-the-counter remedies and its pairing with narcotics in potentially addictive drugs like Vicodin and Percocet can make it too easy for some patients to swallow much more than the maximum recommended dose inadvertently.
"It's extremely frustrating to see people come into the hospital who felt fine several days ago, but now need a new liver," said Dr. Tim Davern, one of the authors and a gastroenterologist with the liver transplant program of the University of California at San Francisco. "Most had no idea that what they were taking could have that sort of effect." The numbers of poisonings, however, are still tiny in comparison with the millions of people who use over-the-counter and prescription drugs with acetaminophen.

Merchant Marine
The Department of Defense Oct.
26 announced it would soon adopt a controversial
personnel policy opposed by
labor unions at sea and ashore.
DOD’s National Security
Personnel System, or NSPS, would
cover an estimated 650,000 civilians
employed by the department and its
agencies.
Among these are licensed and
unlicensed merchant mariners employed
directly by the Navy’s Military Sealift
Command, the National Oceanic and
Atmospheric Administration and the
U.S. Army Corps of Engineers. The
Seafarers International Union, the
International Organization of Masters,
Mates and Pilots and the Marine
Engineers Beneficial Association represent
these civil service mariners, or “CIVMARs.”
DOD has agreed to
exclude CIVMARs from the human
resources, payroll and appeals rules under
NSPS, but not from the labor-management
relations rules.
American Maritime Officers does not
represent civil service mariners in the MSC,
NOAA or Army Corps fleets. However, the
union has supported the SIU, the IOMM&P
and MEBA in their battle to block the NSPS
regime.
“This is a labor issue—no doubt
about it,” said AMO National Executive
Vice President Tom Bethel. “Under NSPS,
the Department of Defense could hire, fire,
promote or demote employees almost at
will, and the employees would have no
recourse.”
Bethel added: “This is also a national
security issue. NSPS could drive
CIVMARs from the MSC fleet ashore into
new careers, and replacing these mariners
would be difficult, if not impossible. This
would aggravate the known shortage of
skilled seagoing labor for defense sealift
and other military support services.”
DOD “could also decide at some
point that it wants NSPS applied in the government-
chartered fleet, the vessels operated
for MSC by U.S.-flagged shipping companies
in the private sector. This would
harm our union directly and significantly
and chip even deeper into the civilian sealift
manpower

DOD published the new work rules in
the Federal Register Oct. 27, setting off a
30-day Congressional and public review
period. The department expects to launch
NSPS immediately thereafter.
Therefore, a labor coalition led by
the American Federation of Government
Employees said it would file a lawsuit to
block the labor-relations portion of NSPS.
Responding last August in an action
brought by the AFGE, a federal court found
fault with similar rules proposed for the
Department of Homeland Security. U.S.
District Judge Rosemary M. Collyer said
the rules had undermined employees’ legally
protected right to collective bargaining.

Consideration of further Jones Act waivers should be made on case-by-case basis
“The American domestic fleet and
members of Congress did not oppose the
first waiver (in September) because of the
catastrophic nature of the situation,” the
Senators wrote. “The second waiver,
though, was surprising in light of the welldocumented
availability of U.S. vessels
and the operational capacity of our
nation’s pipeline infrastructure.”
The Senators said the Jones Act
waivers “may not have been necessary.”
They explained that their staffs were
briefed on the crisis in detail by the
Departments of Homeland Security,
Energy and Transportation but had
received no data “to support the suggestion
that this blanket waiver is necessary
to advance the flow of petroleum products
between points in the United States.”
Jones Act waivers “can have a negative
impact on the American maritime
industry if not issued judiciously,”
Senators Stevens, Inouye and Lott
advised. “We are grateful for this administration’s
… support for the Jones Act.
However, the two consecutive blanket
waivers, which appear unnecessary to
address the few situations requiring the
use of foreign-flag vessels, undermine that
support.”
The Senators added: “(We) hope
you can appreciate our frustration when
American tankers and tank vessels with
American crews are available in the Gulf
but are bypassed by foreign-flag vessels
operating inside of our waters outside of
our laws. If the goal is to move refined
product seamlessly between coastwise
points in the U.S., these American vessels
are available and ready to help. Instead,
we have received reports of U.S.-flag
tanker charters being cancelled immediately
after the waiver was announced, and
of American tank vessel capacity standing
by unused.”

MARINERS HAVE PROBLEMS WITH ISPS, SAYS SURVEY
The International Ship and Port Facility Security (ISPS) code is improving
security at the expense of seafarers who are increasingly overworked and
treated with suspicion, according to an International Transport Workers'
Federation (ITF) survey. This is happening at a time when disproportionate
security measures not related to the code are also having a negative impact
on crews, the Federation says.
The ISPS code was widely seen as a successful example of the 'fast tracking'
of legislation when it was introduced in response to the 9/11 attacks in the
U.S. However the ITF survey shows that the welcome security gains are being
undermined by lack of trust and support for the seafarers tasked with
implementing it. The ITF has been broadly supportive of ISPS and applauded
the consultative manner in which it was drawn up. However, there have always
been concerns about a possible negative impact on seafarers, as a result of
which the Federation initiated the survey, which was sent to its 127
inspectors and 230 affiliated maritime unions - which represent around
700,000 seafarers - for them to consult their members and report back.
The results - published as the report "Access Denied: Implementing the ISPS

The overwhelming response to the survey was that ISPS had seriously
increased seafarers' workloads without any increase in staff, pay or
training, and was associated with the grave problems experienced with shore
leave, especially in the U.S. Although the ISPS code includes provisions to
avert problems of access to ports, shore leave and welfare facilities, it is
clear from the survey that these are being neglected in the Code's
implementation.

Serious areas of concern highlighted in the survey responses include:
Increased workload and responsibility; No commensurate increase in pay;
Inadequate training; Restrictions on shore leave; Problems in obtaining
United States visas; and Difficulties for seafarers' welfare and trade union
representatives seeking to board vessels to provide services to crew.
Jon Whitlow, Secretary of the ITF's Seafarers' Section, said, "All
responsible parties back the aim of the ISPS code. But there's a gap between
principle and practice. The measures that were supposed to protect seafarers
are too often being neglected. Combine that with other excessive security
measures being implemented outside the code and you have a grave and
counter-productive climate of distrust and suspicion being created out
there.The survey once again shows that the main problems include overwork,
visa difficulties and the denial of shore leave - amounting to virtual
discrimination just at a time when seafarers need to be treated as allies in
the fight against terrorism and when everyone in the industry is trying to
attract newcomers into the profession."

BOSTON (Reuters) - Jennifer Myung owes $55,000 to the U.S. government, and for the first time, she isn't worried about paying it back. That's because she has swapped a budding career as a concert violinist for an investment banking job.
Myung made that career switch in October. With two graduate degrees from Boston's New England Conservatory, the 25-year-old gifted violinist turned down a rare opening with the New World Symphony and an audition for the Boston Symphony Orchestra.
A recent $100 million anonymous gift to the Yale School of Music that allows students a year of free study has stirred debate on the costs of studying performing arts in the United States and whether Washington should do more to help.
With the cost of tuition rising every year and conservatory students spending as much as six years in school, many like Myung are swamped in debt as they enter a field in which jobs are scarce and salaries often low.
"Even if you do music really well, there's no guarantee that you'll get a job," said Myung.
The Yale donation -- the largest ever at the prestigious U.S. university -- announced in October will cover tuition costs of all matriculating students next year.
It was followed a month later by a $40.6 million gift to the Indiana University School of Music and has cast attention on students like Myung, who said the prospect of years of debts drove her to give up the violin.
"Students are leaving schools burdened with debt between $20,000 and $40,000," said Thomas Duffy, acting dean of the Yale School of Music. "We don't want to expand our program on the backs of our students ... That would be unconscionable."

I have just returned from my fourth trip to Iraq in the past 17 months and can report real progress there. More work needs to be done, of course, but the Iraqi people are in reach of a watershed transformation from the primitive, killing tyranny of Saddam to modern, self-governing, self-securing nationhood--unless the great American military that has given them and us this unexpected opportunity is prematurely withdrawn.
Progress is visible and practical. In the Kurdish North, there is continuing security and growing prosperity. The primarily Shiite South remains largely free of terrorism, receives much more electric power and other public services than it did under Saddam, and is experiencing greater economic activity. The Sunni triangle, geographically defined by Baghdad to the east, Tikrit to the north and Ramadi to the west, is where most of the terrorist enemy attacks occur. And yet here, too, there is progress.
There are many more cars on the streets, satellite television dishes on the roofs, and literally millions more cell phones in Iraqi hands than before. All of that says the Iraqi economy is growing. And Sunni candidates are actively campaigning for seats in the National Assembly. People are working their way toward a functioning society and economy in the midst of a very brutal, inhumane, sustained terrorist war against the civilian population and the Iraqi and American military there to protect it.

It is a war between 27 million and 10,000; 27 million Iraqis who want to live lives of freedom, opportunity and prosperity and roughly 10,000 terrorists who are either Saddam revanchists, Iraqi Islamic extremists or al Qaeda foreign fighters who know their wretched causes will be set back if Iraq becomes free and modern. The terrorists are intent on stopping this by instigating a civil war to produce the chaos that will allow Iraq to replace Afghanistan as the base for their fanatical war-making. We are fighting on the side of the 27 million because the outcome of this war is critically important to the security and freedom of America. If the terrorists win, they will be emboldened to strike us directly again and to further undermine the growing stability and progress in the Middle East, which has long been a major American national and economic security priority.

In the face of terrorist threats and escalating violence, eight million Iraqis voted for their interim national government in January, almost 10 million participated in the referendum on their new constitution in October, and even more than that are expected to vote in the elections for a full-term government on Dec. 15. Every time the 27 million Iraqis have been given the chance since Saddam was overthrown, they have voted for self-government and hope over the violence and hatred the 10,000 terrorists offer them. Most encouraging has been the behavior of the Sunni community, which, when disappointed by the proposed constitution, registered to vote and went to the polls instead of taking up arms and going to the streets. Last week, I was thrilled to see a vigorous political campaign, and a large number of independent television stations and newspapers covering it.
None of these remarkable changes would have happened without the coalition forces led by the U.S. And, I am convinced, almost all of the progress in Iraq and throughout the Middle East will be lost if those forces are withdrawn faster than the Iraqi military is capable of securing the country.
The leaders of Iraq's duly elected government understand this, and they asked me for reassurance about America's commitment. The question is whether the American people and enough of their representatives in Congress from both parties understand this. I am disappointed by Democrats who are more focused on how President Bush took America into the war in Iraq almost three years ago, and by Republicans who are more worried about whether the war will bring them down in next November's elections, than they are concerned about how we continue the progress in Iraq in the months and years ahead.

Here is an ironic finding I brought back from Iraq. While U.S. public opinion polls show serious declines in support for the war and increasing pessimism about how it will end, polls conducted by Iraqis for Iraqi universities show increasing optimism. Two-thirds say they are better off than they were under Saddam, and a resounding 82% are confident their lives in Iraq will be better a year from now than they are today. What a colossal mistake it would be for America's bipartisan political leadership to choose this moment in history to lose its will and, in the famous phrase, to seize defeat from the jaws of the coming victory.
The leaders of America's military and diplomatic forces in Iraq, Gen. George Casey and Ambassador Zal Khalilzad, have a clear and compelling vision of our mission there. It is to create the environment in which Iraqi democracy, security and prosperity can take hold and the Iraqis themselves can defend their political progress against those 10,000 terrorists who would take it from them.

The contrast between the editorial pages of the Wall Street Journal and of the Financial Times, the two main business dailies worldwide, is becoming increasingly striking. On energy policy, Europe, the environment, they have pretty much opposed views. In part, that reflects the growing divide between Europe and America on these topics and others (the latest on being torture and extraordinary renditions), but the Euro-Atlantic business community used to be a lot closer even when public opinion was divergent. No longer.
Today's op-ed pieces on Iraq (both written by Americans) are particularly symbolic:

There is a remarkable article in the latest issue of the American Jewish weekly, Forward. It calls for President Bush to be impeached and put on trial "for misleading the American people, and launching the most foolish war since Emperor Augustus in 9 BC sent his legions into Germany and lost them".
To describe Iraq as the most foolish war of the last 2,014 years is a sweeping statement, but the writer is well qualified to know.
