LIBBY INDICTED -- FACES 30 YEARS IN PRISON

Lewis "Scooter" Libby, Vice President Dick Cheney's chief of staff, was indicted today by a grand jury on one count of obstruction of justice, two counts of making false statements and two counts of perjury in the CIA leak probe.
Text of the indictment. (via Campus Progress.)
Why it matters (from the indictment):
"The responsibilities of certain CIA employees required that their association with the CIA be kept secret. As a result, the fact that these individuals were employed by the CIA was classified. Disclosure of the fact that such individuals were employed by the CIA had the potential to damage the national security in ways that ranged from preventing the future use of those individuals in a covert capacity, to compromising intelligence gathering methods and operations and endanger the safety of CIA employees and those who dealt with them."
Statement by Senate Democratic Leader Harry Reid:
"These are very serious charges. They suggest that a senior White House aide put politics ahead of our national security and the rule of law.
"This case is bigger than the leak of highly classified information. It is about how the Bush White House manufactured and manipulated intelligence in order to bolster its case for the war in Iraq and to discredit anyone who dared to challenge the president.
"It's now time for President Bush to lead and answer the very serious questions raised by this investigation. The American people have already paid too steep a price as a result of misconduct at the White House, and they deserve better."

Does Fitz continue the investigation or will there be a new special prosecutor?
Does he use the same or a new grand jury...or none at all?
As long as Fitz (or a replacement) keeps on investigating, I'm pleased.

Karl Rove, Bush's closest adviser, escaped indictment Friday but remained under investigation, his legal status a looming political problem for the White House.
The indictment charged Libby, 55, with one count of obstruction of justice, two of perjury and two false statement counts. If convicted on all five, he could face as much as 30 years in prison and $1.25 million in fines.

As I understand it, there has been no change in status for the Rove investigation.
It appears clear the Special Investigators are unwilling to dismiss Rove's actions and are either going to pursue an extension for the Grand Jury or wait to see what the prosecussion of Libby yeilds in regards to proof for a Rove indictment.

It is a crime! There is a law, though not a good law, that you cannot out an undercover CIA agent.
However it is much harder to prove.
So Fitz went after the other indictments. Lying about prior knowledge and lying about reporters telling him rather than the other way around.

Sure, Fitz would allow a lesser plea by a littler fish (or even immunity, conceivably) to allow him to land a bigger fish.
That's the very nature of flippin' your way up the pay grade.
That said, it *might* be the reason Unca Karl ain't been indicted yet (or it might not).
Also, bear in mind: for Libby to be the one who flipped, as you conjecture, I suspect Fitgerald would need the Sword of Damocles indictments-motherload hanging over Libby's head before he'd be the one singing *after* being indicted in the fashion he already has.
Libby didn't cut a deal, imo, and he's taking his chances in court.
Rove is an open question.
Notice, too, that Hannah, Wurmser, Hadley and alla the usual suspects *weren't* indicted today?

My guess is that plea deal would not include dropping his offenses, but rather a lightening of his sentence.

Which, again, *might* be part of the reason Rove wasn't indicted today.
If the littler fish were indicted today, what incentive would they have to cooperate with Fitzgerald's investigation in helping to land the bigger fish?
But if their fate is an open question, subject to cooperation, it sort of changes the equation.
This is why I don't suspect Libby flipped on Cheney.
Libby got indicted as harshly as he could be (w/o diminishing the still-valid option for further and more damning charges later -- for Libby and potentially for higher-ups -- by giving the game away too early on Libby).
No reason for Libby to cooperate at this point *unless* the charges were dropped b/c he agreed to cooperate (i.e. Cheney).
In essence, Fitzgerald simply made good on the threat of legal jeopardy w/an object lesson on Libby. Folks involved know he's serious.
So, now w/the investigation continuing, all persons involved in the affair are put on notice:
1. They can take their chances in court like Scooter and hope they either are not convicted or, if convicted, pardoned.
or
2. They can cooperate w/Fitzgerald's investigation.
or
3. They can hope Bush impetuously quashes the investigation and is willing to take the firestorm of betrayed disapproval such a selfish maneuver would engender for a 38-percent approval president.

WASHINGTON (CNN) -- As the White House turns its attention to finding a new Supreme Court nominee, conservative activists relieved at Harriet Miers' withdrawal are vowing to oppose President Bush's next nominee unless the candidate has solid conservative credentials.
"I think [conservative groups] will swing into action again" if they disagree with his next pick, said Phyllis Schlafly, president of Eagle Forum. "The judicial issue was a major issue in the 2004 elections, and it was a reason why many people voted for Bush even though they might have been unhappy [with him] for other reasons."
No announcement concerning a new nominee was expected Friday.
Schlafly said Bush has "a dozen" possible people that conservative activists would accept, while she singled out U.S. Attorney General Alberto Gonzales as a nominee they could not embrace. (Possible nominees)
"It is hard to find anyone else like Miers, unless you are talking about Gonzales," she said. "Most of the same arguments would be there. I think [conservative critics] would simply pick up where they left off."

I saw this little fluff news piece one morning a few weeks ago while looking for a weather report, about house fires. The newscaster said something like "more americans died in house fires last year than died in Iraq."
The problem with comparing these two numbers is that America has a few hundred million people in it, and there are less than two hundred thousand American troops in Iraq.
This kind of misrepresentation is inexcusable.

While many people were left confused by news reports that said Rove wouldn't be indicted Friday, the lawyers said that Rove remains under intense scrutiny and added that Fitzgerald is betting on the fact that he can secure an indictment against Rove on charges of perjury, obstruction of justice, the misuse of classified information, and possibly other charges, as early as next week.
“This investigation is not yet over,” one of the lawyers in the case said. “You must keep in mind that people like Mr. Rove are still under investigation. Rather than securing an indictment on perjury charges against Mr. Rove Mr. Fitzgerald strongly believes he can convince the grand jury that he broke other laws.”

NATO sources told United Press International Monday that Fitzgerald's team of investigators has sought and obtained documentation on the forgeries from the Italian government.
According to the report, "Fitzgerald's team has been given the full, and as yet unpublished report of the Italian parliamentary inquiry into the affair, which started when an Italian journalist obtained documents that appeared to show officials of the government of Niger helping to supply the Iraqi regime of Saddam Hussein with Yellowcake uranium.

The New York Times last night [wrote] that Rove "will remain under investigation, people briefed officially about the case said. As a result, they said, the special counsel in the case, Patrick J. Fitzgerald, was likely to extend the term of the federal grand jury beyond its scheduled expiration on Friday."
One thing I can add to the debate over what Fitzgerald's options are when it comes to continuing his scrutiny of Rove: I have it on impeccable authority that there is absolutely no way that Fitzgerald could extend the term of this particular grand jury.
[What? The NYTs gets it wrong again? Shocked! I'm shocked!]
Fitzgerald has been on the case for 22 months, but he is using a regular federal grand jury that was impaneled two months earlier -- in late October 2003.
Grand juries typically are impaneled for 18 months.
The rules are clear: They can be extended in extraordinary circumstances for six more months, as this one has been.
But beyond that there are absolutely no exceptions.
So if Fitzgerald wants to pursue this investigation, he'll have to use another grand jury.
That's quite doable -- he would just have FBI agents read out loud, to the new grand jury, the relevant testimony from the old grand jury, and then take it from there.
But the group of jurors who actually heard Rove's testimony with their own ears will officially be disbanded -- and sworn to secrecy -- as of today.

In one of the boldest moves yet in the 22-month investigation into the outing of a covert CIA agent to a handful of top reporters covering the White House, Special Prosecutor Patrick Fitzgerald is extending his probe and pursuing much more serious charges against senior White House officials, specifically President Bush’s Deputy Chief of Staff Karl Rove, lawyers directly involved in the case told RAW STORY Friday.
While many people were left confused by news reports that said Rove wouldn't be indicted Friday, the lawyers said that Rove remains under intense scrutiny and added that Fitzgerald is betting on the fact that he can secure an indictment against Rove on charges of perjury, obstruction of justice, the misuse of classified information, and possibly other charges, as early as next week.
“This investigation is not yet over,” one of the lawyers in the case said. “You must keep in mind that people like Mr. Rove are still under investigation. Rather than securing an indictment on perjury charges against Mr. Rove Mr. Fitzgerald strongly believes he can convince the grand jury that he broke other laws.”

In 1997, Libby helped found the Project for the New American Century, a Washington-based Republican think tank with the goal of promoting "American global leadership." With William Kristol, Robert Kagan and others, Libby wrote its 2000 report entitled, "Rebuilding America's Defenses: Strategy, Forces, and Resources for a New Century."
It was not the first time Libby had written about defending America. He co-authored the draft of the "Defense Planning Guidance" with Wolfowitz for then-Defense Secretary Cheney in 1992.
During the George H. W. Bush administration, Libby served in the United States Department of Defense as principal deputy under uecretary (Strategy and Resources), and later was confirmed by the Senate as deputy under secretary of defense for policy.

Fitzgerald said he will be keeping the grand "jury open to consider other matters." But, he said, "substantial work" is done.
Libby resigned Friday after a federal grand jury indicted him on charges related to the leak probe, including one count of obstruction of justice, two counts of perjury and two counts of making false statements.
During an afternoon news conference, Fitzgerald said, "A CIA officer's name was blown and there was a leak and we needed to figure out how that happened, who did it, why, whether a crime was committed, whether we could prove it, whether we should prove it. Given national security was at stake, it was especially important that we find out accurate facts."

BATON ROUGE -- Nearly two weeks after Hurricane Katrina's hundreds of dead bodies were still uncollected, the Houston company hired to recover the dead asked federal agencies to find a new contractor because it was exasperated with government dithering and lack of support, according to a letter from a company executive.
On Sept. 11, Kenyon International Emergency Services Chief Executive Officer Robert Jensen complained to Coast Guard Vice Adm. Thad Allen, the principal officer for the federal response to Katrina, that "numerous roadblocks, hindrances, and interferences have resulted in a situation making it impossible for Kenyon to maintain its standards when recovering the bodies of victims in this disaster," according to a letter obtained by The Times-Picayune.
The letter includes a company timeline showing that in the first few days after the hurricane, the Federal Emergency Management Agency changed the location and plans for Kenyon's operations base several times and failed to respond to multiple inquiries by the company for instructions.

COLUMBUS, Ohio (AP) — Two Cincinnati attorneys claim several pro-family, anti-gay organizations which have been active in election issues concealed more than $2 million in campaign contributions.
They said they would file a complaint Thursday with the Ohio Elections Commission.
The complaint cites last year's campaign for a state constitutional amendment to ban same-sex marriages and the battle in Cincinnati over repeal of an ordinance that prohibited passage of a gay rights law.
Filing the complaint are former Cincinnati mayor Bobbie Sterne and Gary Wright, chairman of Equality Cincinnati, the successor to the group which led the successful repeal effort.
Named in the complaint are Cincinnati-based Citizens for Community Values and its president, Phil Burress; officers of Equal Rights, No Special Rights, and Focus on the Family, of Colorado Springs, Colo.
The complaint claims that only $13,000 of $2.4 million spent by the groups was disclosed on campaign finance reports as required by state law.
"This is a witch hunt," Burress said Wednesday. "This is pure politics at its dirtiest moment and nothing short of harassment. We have complied with every law."

My advice is to buy the Russell 1000 large and mid-cap fund.
The US stock market, when weighted by company size, is dominated by large companies. So a total market fund is dominated by large cap companies.
By splitting the portfolio into two, you can increase your exposure to small and medium sized companies.
Why might you want to do this?
Historical data suggest that small company stocks, while riskier, appreciate more over time.
The Russell split is better for taxable accounts, as the Russell 1000 fund doesn’t need to sell stocks (and realize capital gains) if they graduate from mid-cap to large cap status, whereas the S&P Mid-cap 400 index fund will sell stocks if they are promoted to the S&P 500 (large cap) index.

The European Union's offer today to cut its farm tariffs by as much as 60 percent falls short of expectations because the proposal allows exemptions that would block key exports, U.S. officials and industry groups said.

U.S. lawmakers and industry groups said the proposal would effectively block the products most likely to be exported by American farmers to Europe. They didn't specify which products.
In the face of fierce opposition from France, the 25-nation European Union offered to trim agriculture tariffs by 35 percent to 60 percent, and implement a cap that would limit remaining duties to no more than 100 percent of the value of an import.
The EU also said it would lower by 70 percent its trade- distorting farm subsidies, locking in reductions it has already made, and would phase out export subsidies.
The offer today attempted to match a proposal the U.S. made earlier this month to cut its trade-distorting farm subsidies, as negotiators try to bridge what has been the main impediment to the so-called Doha Round of World Trade Organization talks.
``It is a modest step in the right direction, but I just think it is inadequate to reach the mandate of Doha,'' Portman said.
Senator Max Baucus of Montana, the top Democrat on the Senate Finance Committee, which oversees trade and tariff matters, also called the proposal inadequate and said it may endanger prospects for next month's summit of the 148 WTO members in Hong Kong.

We need to scale back the farming subsidies and addendums (pork barrel) to the appropriations bills.
Also the fraud, waste and abuse with regards to the contractors at the Pentagon; must be immediately given Congressional oversight.
They aren't even accounting for the spending anymore.
That's a grievous crime on par with nearly 100 billion dollars, almost half of the funds allocated to Katrina alone.

Vice President Cheney and his chief of staff, I. Lewis "Scooter" Libby, overruling advice from some White House political staffers and lawyers, decided to withhold crucial documents from the Senate Intelligence Committee in 2004 when the panel was investigating the use of pre-war intelligence that erroneously concluded Saddam Hussein had weapons of mass destruction, according to Bush administration and congressional sources.
Among the White House materials withheld from the committee were Libby-authored passages in drafts of a speech that then-Secretary of State Colin L. Powell delivered to the United Nations in February 2003 to argue the Bush administration's case for war with Iraq, according to congressional and administration sources. The withheld documents also included intelligence data that Cheney's office -- and Libby in particular -- pushed to be included in Powell's speech, the sources said.
The new information that Cheney and Libby blocked information to the Senate Intelligence Committee further underscores the central role played by the vice president's office in trying to blunt criticism that the Bush administration exaggerated intelligence data to make the case to go to war.

The Intelligence Committee at the time was trying to determine whether the CIA and other intelligence agencies provided faulty or erroneous intelligence on Iraq to President Bush and other government officials. But the committee deferred the much more politically sensitive issue as to whether the president and the vice president themselves, or other administration officials, misrepresented intelligence information to bolster the case to go to war. An Intelligence Committee spokesperson says the panel is still working on this second phase of the investigation.
Had the withheld information been turned over, according to administration and congressional sources, it likely would have shifted a portion of the blame away from the intelligence agencies to the Bush administration as to who was responsible for the erroneous information being presented to the American public, Congress, and the international community.
In April 2004, the Intelligence Committee released a report that concluded that "much of the information provided or cleared by the Central Intelligence Agency for inclusion in Secretary Powell's [United Nation's] speech was overstated, misleading, or incorrect."
Both Republicans and Democrats on the committee say that their investigation was hampered by the refusal of the White House to turn over key documents, although Republicans said the documents were not as central to the investigation.
In addition to withholding drafts of Powell's speech -- which included passages written by Libby -- the administration also refused to turn over to the committee contents of the president's morning intelligence briefings on Iraq, sources say. These documents, known as the Presidential Daily Brief, or PDB, are a written summary of intelligence information and analysis provided by the CIA to the president.

It's a regular, not a special, grand jury. As such it can be extended once, which it already has, for up to six months.
Up to that point you are correct.
What you either dishonestly (i.e. lying by omission) or ignorantly (just a dumbass spouting off) fail to mention is that the investigation can be handed over to a different (i.e. successively new) grand jury.
Evidently one is always seated in D.C.

Heard a fascinatin' piece on crows and ravens on NPR the other day. Some guy wrote a book onnem(w/another fella, who evidently did some very fine illustrations to accompany).
Conversation talked about West Nile and how it decimated the crow/raven population in the upper Midwest and Northeast/mid-Atlantic regions (last year, believe it was, but coulda been longer ago, don't rightly 'member).
Crows and ravens are evidently the canary inna coal mine when it comes to West Nile, being highly susceptible to infection and dying in astounding numbers from an outbreak.
fyi: Crows and ravens are also evidently highly skilled mimics, and, had this been a better known behavioral trait, instead of "the chattering imbecilities of mynah bird blogdom" to describe Gare, I'da picked a crow or raven.
(Parrot was ground a little too well-trod since options was available.)
Another inneresting curio: crows and ravens have a peculiar behavioral trait remniscent of Shirley Jackson's horrific little short story: The Lottery.
Crows and ravens evidently will gather in a group and, at times, and for inexplicable reasons, single out one individual w/in their ranks and savagely gang up on it and kill it.
And such a grouping of crows/ravens is called?
A "murder".

the celtics have special meanings for Owls.
We had a huge one living near us in San Diego.
It would fly around at dusk. IT's wing span was at least 6FT!
Beauitful and so quiet when it would fly.

The White House is trying its best to appear positive today. President Bush appeared smiling and laughing before reporters this morning, while Karl Rove said he was in a “very good mood today. I’m going to have a very good day.”
The truth is that special prosecutor Patrick Fitzgerald’s expected announcement — that at least one White House official will be indicted, while Rove remains under investigation — is extremely bad news. This morning, even Bush loyalist Ann Coulter admitted that this is the “worst possible scenario” for the administration:

Today on Wolf Blitzer's show, The Situation Room, correspondent David Ensor brought up the criticism that has been circulated by folks like Cliff May saying that Valerie Plame compromised her cover by marrying a high profile diplomat like Joe Wilson.
I called David afterwards and had a pleasant conversation to clarify that this is a red herring. As I told David, I know of several CIA undercover officers who are married to so-called high profile people. The reality is that their identity is not known to the public and could only be made known to the public if they revealed their identity or someone else familiar with them did. One of these people is a friend of mine, happily married, and serving the United States as a spymaster overseas.
There is another reason to shoot down the silly and specious claim that Val essentially outed herself by marrying Joe. At no point prior to Bob Novak's column is there a public reference to Valerie as a CIA officer. Moreover, Joe Wilson did not advertise the fact that he had done contracting work for the CIA (i.e., he had been sent on previous missions overseas). Val's cover, while not heavily backstopped, was adequate to allow her to work overseas on sensitive missions.

Libby indictment names Rove - or 'Official A' - as confirming Plame's identity to Libby

The indictment and resignation of Scooter Libby on Good Friday is just the beginning. The best news is that a new grand jury was impaneled.
Libby’s indictment includes a passage in which an "Official A" told Libby that he had talked with conservative syndicated columnist Robert Novak about CIA officer Valerie Plame and that Novak would be writing a story about Plame.
And who is “Official A?” None other than Karl Rove, according to my sources.
Rove and Novak go way back in such dirty tricks. In 1992, Rove, with help from Novak, with whom Rove has often dined, smeared Robert Mosbacher Jr., George H.W. Bush’s then-presidential campaign manager. Mosbacher gave John Weaver, a Rove competitor, the bulk of a $1 million direct mail contract, and Rove spread a story that Mosbacher had been replaced in Texas by another campaign manager, which Novak repeated in a column. Poppy Bush reportedly dismissed Rove from his campaign for doing that, but his son will not do so for doing worse in the Plame case.
But expect Rove to go down eventually. Prosecutor Patrick Fitzgerald is just building the case against Rove and possibly others.
It's actually good news that the indictment process didn't end Friday. It keeps the whole matter open and keeps Rove - and Bush since Rove is "Bush's Brain" - squirming.

There are reports that Rove lied to the FBI and did not disclose that he had ever discussed Plame with Time magazine reporter Matthew Cooper during Rove's first interview with the FBI. So Rove could be facing obstruction of justice and perjury charges himself, the same kind that got Libby.

Exxon-Mobil Workers Got Fake Flu Shots By WENDY BENJAMINSON, Associated Press Writer

HOUSTON - As many as 1,000 Exxon Mobil employees and 14 residents of a senior citizens home were injected with fake flu vaccine, authorities said Friday, and the owner of a home health care company was arrested.
Preliminary tests indicated the syringes were filled with purified water, U.S. Attorney Chuck Rosenberg said. And no ill effects from the shots were reported.
But Hermina Palacio, head of the Harris County health department, recommended that people who received the shots get tested for blood-borne pathogens such as the AIDS virus and hepatitis B and C.
Exxon Mobil offered blood tests and counseling to the employees who received the shots at a health fair Oct. 19-20 at the oil company's complex of refineries and chemical plants in Baytown, just east of Houston.

House Panel OKs School Lunch Funding Cut

WASHINGTON - The House Agriculture Committee approved budget cuts Friday that would take food stamps away from an estimated 300,000 people and could cut off school lunches and breakfasts for 40,000 children.
The action came as the government reported that the number of people who are hungry because they can't afford to buy enough food rose to 38.2 million in 2004, an increase of 7 million in five years. The number represents nearly 12 percent of U.S. households.
"If there are cuts to be made, why should we make them on food stamps?" said Rep. David Scott (news, bio, voting record), D-Ga. "This is the meanest cut of all."
The cuts, approved by the Republican-controlled committee on a party-line vote, are part of an effort by the House GOP to curb federal spending by $50 billion. The food and agriculture cuts would reduce spending by $3.7 billion, including $844 million on nutrition, $760 million on conservation and $212 million on payments to farmers.

The associates spoke on condition of anonymity because they are not authorized to speak to the media. They are in regular contact with al-Sistani and call routinely on the 76-year-old cleric at his home in the holy city of Najaf south of Baghdad.
The reclusive al-Sistani rarely leaves his home and limits his public comments to religious decrees, or fatwas. He has steadfastly refused to meet with any American officials since the U.S.-led invasion toppled Saddam Hussein's regime in 2003.
But al-Sistani's influence among the majority Shiite community is vast, and a public call for such a timetable would put enormous pressure on Washington to comply.

He is no longer pursuing Rove, Cheney, or others, but the case is still open. That means if something is dumped in his lap he will act upon it accordingly.
Also, and again, if you paid attention, there was no outing of an undercover agent. Plames identity as a CIA Agent was classified. I have no idea at what level. It could have been merely Confidential for all I know and I think it doubtful it would be Top Secret, or even Secret. You got it??? There was no outing of an undercover agent. That is why Fitzgerald used other legal codes to get Libby.
Damn, I really don't think you are the rockhead you sometimes come across as, but I do think your political biases prevent you from seeing things objectively.
In all liklihood Rove ain't gonna be indicted unless someone jumps in to give Fitzgerald some new information. Get over it!!

By Bush administration standards, the choice of Ben Bernanke to succeed Alan Greenspan as chairman of the Federal Reserve was just weird.
For one thing, Mr. Bernanke is actually an expert in monetary policy, as opposed to, say, Arabian horses.
Beyond that, Mr. Bernanke's partisanship, if it exists, is so low-key that his co-author on a textbook didn't know he was a registered Republican. The academic work on which his professional reputation rests is apolitical. Moreover, that work is all about how the Fed can influence demand - there's not a hint in his work of support for the right-wing supply-side doctrine.

So should we all feel confident about the economic future, assuming that Mr. Bernanke is confirmed? Alas, no.
No, my main concern is that the economy may well face a day of reckoning soon after Mr. Bernanke takes office. And while he is surely the best politically possible man for the job (all the other candidates I would have been happy with are independents or Democrats), coping with that day of reckoning without some nasty shocks may be beyond anyone's talents.
The fact is that the U.S. economy's growth over the past few years has depended on two unsustainable trends: a huge surge in house prices and a vast inflow of funds from Asia. Sooner or later, both trends will end, possibly abruptly.

Your nitpicking the difference between Plame's status being 'undercover' vs. 'classified by the C.I.A.' Revealing either, of course, is a crime.
